Terms of Use for MarkForge

1. Scope

These Terms of Use govern the use of the macOS application "MarkForge" (hereinafter referred to as "Software" or "Application"), developed and distributed by Norbert Gutbrod (hereinafter referred to as "Provider").

By downloading, installing, or using MarkForge, you agree to these Terms of Use.

2. License and Usage Rights

2.1 License Grant

The Provider grants you a non-exclusive, non-transferable, revocable license to use the Software for personal or commercial purposes on your own devices.

2.2 Usage Restrictions

You may not:

• Decompile, disassemble, or reverse engineer the Software
• Copy, duplicate, or distribute the Software (except for personal backups)
• Rent, lease, lend, or otherwise make the Software available to third parties
• Remove or modify copyright notices or other legal notices
• Use the Software to develop competing software

2.3 Ownership

All rights to the Software, including all copyrights, trademark rights, and other intellectual property rights, remain with the Provider. These Terms of Use do not transfer any ownership rights to the Software.

3. Software Provision

3.1 Availability

The Software is provided through the Apple App Store. The Provider reserves the right to discontinue the availability of the Software at any time without prior notice.

3.2 Updates and Maintenance

The Provider may provide updates, patches, or new versions of the Software, but is not obligated to do so. Updates may be installed automatically or manually.

3.3 System Requirements

The Software requires macOS 15.0 or higher. The Provider does not guarantee compatibility with future operating system versions.

4. Use of the Software

4.1 Intended Use

MarkForge is exclusively intended for converting Markdown files to PDF documents. Use for other purposes is at your own risk.

4.2 File Responsibility

You are solely responsible for:

• The contents of the Markdown files you process
• Compliance with copyrights and other third-party rights
• Proper backup of your files before processing

4.3 Local Processing

All file processing occurs locally on your device. The Provider has no access to your files or their contents.

5. Warranty and Liability

5.1 Warranty Disclaimer

The Software is provided "AS IS". The Provider makes no warranty that the Software:

• Functions error-free or without interruption
• Is suitable for any particular purpose
• Is compatible with your hardware or other applications
• Meets all your requirements

5.2 Liability Disclaimer

To the extent permitted by law, the Provider is not liable for:

• Data loss or file corruption
• Indirect damages, consequential damages, or lost profits
• Downtime or loss of productivity
• Damages resulting from the use or inability to use the Software

5.3 Limitation of Liability

The Provider's liability is limited to the purchase price of the Software, to the extent permitted by law.

5.4 Mandatory Law

The above liability exclusions do not apply to damages resulting from injury to life, body, or health, or in cases of intent or gross negligence.

6. Support and Maintenance

6.1 Support

The Provider provides support via email (support@markforge.de). There is no entitlement to support. Support requests are handled on a best-effort basis.

6.2 No Maintenance Obligation

The Provider is not obligated to maintain, update, or fix errors in the Software.

7. Termination

7.1 Termination by User

You may terminate use of the Software at any time by uninstalling it.

7.2 Termination by Provider

The Provider may terminate your license with immediate effect if you violate these Terms of Use.

7.3 Consequences of Termination

Upon termination of the license, you must cease using the Software and remove all copies of the Software from your devices.

8. Privacy

The processing of personal data (if any) is carried out in accordance with our Privacy Policy.

MarkForge does not collect, transmit, or store any personal data.

9. Changes to Terms of Use

The Provider reserves the right to change these Terms of Use at any time. Changes will be announced via the website or within the application. Continued use of the Software after notification of changes constitutes acceptance of the modified terms.

10. Applicable Law and Jurisdiction

10.1 Applicable Law

These Terms of Use are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG) and the conflict of laws provisions of International Private Law.

10.2 Jurisdiction

To the extent permitted by law, the place of jurisdiction for all disputes arising from or in connection with these Terms of Use is the Provider's registered office.

10.3 Severability Clause

Should individual provisions of these Terms of Use be or become invalid, the validity of the remaining provisions shall remain unaffected.
